These Terms of Service ("Terms") govern your access to and use of Cvaluate at https://cvaluate.com (the "Service"), operated by [COMPANY LEGAL NAME] of [COMPANY ADDRESS], United Kingdom ("we", "us").
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 16 years old and able to form a binding contract. You are responsible for ensuring your use complies with applicable laws and any employment or confidentiality obligations relating to CV content you upload.
Account
You may need an account to access certain features. You are responsible for safeguarding your credentials and for activity under your account. Notify us promptly of unauthorised access.
The Service
Cvaluate provides AI-assisted analysis of CVs against job descriptions, including scores, suggestions, and rewrites. Output is informational only, not legal, career, or hiring advice. We do not guarantee interviews, offers, or ATS outcomes. You are responsible for verifying suggestions before submitting applications.
Your content
You retain ownership of CVs and other content you upload. You grant us a limited licence to process your content solely to provide and improve the Service, as described in our Privacy Policy. You represent that you have the right to upload the content and that it does not infringe third-party rights or contain unlawful material.
Acceptable use
You agree not to:
- Use the Service for unlawful purposes or to upload malware
- Attempt to reverse engineer, scrape, or overload the Service
- Share account access or resell the Service without permission
- Upload content you do not have permission to process
- Misrepresent AI-generated output as human professional advice
We may suspend or terminate access for breach of these Terms.
Fees
Core features may be offered free during beta or promotional periods. We may introduce paid plans with notice. Any fees will be stated before you are charged. Credit packs and other paid purchases are non-refundable except where required by law or expressly stated at checkout.
Referral programme
From time to time we may operate a referral programme under which existing users can share a personal referral link or code ("Referral Code"). Participation is optional and subject to these Terms.
Referee benefit. A new user who successfully applies a valid Referral Code before their first credit purchase may receive a discount of 10% on that first credit-pack purchase only, applied at checkout when the programme is active and configured. The discount does not apply to later purchases.
Referrer benefit. When a successfully attributed referee completes their first qualifying credit purchase, we may credit the referrer's account with free analysis credits equal to 20% of the credits in that pack (rounded down to a whole credit). Credits have no cash value, are non-transferable, and may only be used within the Service.
Milestone bonus. We may grant a one-time bonus of 100 free analysis credits when a referrer has ten (10) distinct referees who have each completed a qualifying first credit purchase. This bonus is awarded once per account and is discretionary as part of the programme.
Eligibility and attribution. Referral benefits apply only where we successfully attribute the referee to the referrer (via share link or code entry) before the referee's first credit purchase. You may not use your own Referral Code. Self-referrals, duplicate or fake accounts, automated abuse, or any attempt to game the programme void eligibility. We may reverse credits, withhold rewards, suspend accounts, or cancel referrals where we reasonably believe fraud or abuse has occurred.
Programme changes. The referral programme is promotional. We may modify, suspend, or end it at any time, including reward amounts, eligibility rules, and availability of discounts, without liability to you except for rewards already irrevocably credited for completed qualifying purchases under the rules then in force. Published marketing copy is illustrative and does not create a contractual entitlement beyond these Terms.
No warranties. We do not guarantee that a Referral Code will be accepted, that a discount will appear at checkout, or that rewards will be granted within any particular time. Technical errors, payment failures, chargebacks, or incomplete attribution may prevent rewards. Referral credits and discounts are provided "as is" and are excluded from any warranty to the fullest extent permitted by law.
Limitation of liability under these Terms applies fully to the referral programme. Nothing in this section excludes liability that cannot be limited under English law.
Intellectual property
We own the Service, branding, software, and documentation. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as intended.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI outputs may be incomplete or inaccurate.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our total liability for claims arising from the Service is limited to the greater of (a) amounts you paid us in the twelve months before the claim or (b) £100, except where liability cannot be limited by law.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded under English law.
Termination
You may stop using the Service at any time. We may terminate or suspend the Service or your account with notice where reasonable, or immediately for material breach. Provisions that by nature should survive (including liability limits, governing law, and your content licence for already-processed data) survive termination.
Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, subject to mandatory consumer protections in your country of residence if you are a consumer.
Changes
We may update these Terms. Continued use after the effective date constitutes acceptance of the revised Terms. We will indicate the "Last updated" date at the top of this page.
